
A Peck man is scheduled to be sentenced Wednesday afternoon on three charges of distributing and/or promoting child sexually abusive material, but whether or not he will get the maximum 15 year sentence for the crimes remains to be seen.
30-year-old Anthony Caulkins of Peck pleaded guilty to the three counts this past July, having been offered a plea deal that dropped 13 other related charges, including an additional count of child sexually abusive activity–aggravated distribution, four counts of child sexually abusive material–aggravated possession, and eight counts of using a computer to commit a crime.
However, on Tuesday, September 16, a day prior to his scheduled sentencing, two documents were filed on his behalf. Defense lawyer Amber Renee Lee filed a sentencing memorandum, a document which provides further explanation by the defense as to why the defendant should receive a lesser sentence.
The defense also objected to the sentencing’s offense variable scoring, which is the process used to calculate the appropriate sentence for the crime and its perpetrator by rating factors such as physical, mental or emotional harm done to the offense’s victim or other aggravating circumstances of the crime.
It is unclear how successful the defense will be, with sentencing still scheduled for 1:30 p.m. this afternoon.
