City of Port Huron cited for COVID related violations

The City of Port Huron has been fined $6,300 for violations of COVID-19 workplace safety requirements including failure to require face coverings, not conducting daily entry self-screening protocols for employees, not training employees on COVID-19, and failing to maintain records of the daily entry self-screening protocols.

The inspection was initiated in response to a complaint that was filed. According to the citation, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.

Employees were not protected from the hazard of contracting the virus, SARS-CoV-2. Additionally, the employer did not conduct a daily entry self-screening protocol for all employees entering the workplace, including, at a minimum, a questionnaire covering symptoms and suspected or confirmed exposure to people with possible COVID-19.

Employees were delegated the task and left to “self-screen” on their own.

Further, the employer did not maintain records of the daily entry self-screening protocols and had not conducted employee training on COVID-19 that covered social distancing, the use of face coverings, appropriate hand hygiene, and workplace infection control methods.

The citation went on to add the employer did not require face coverings in shared spaces, including during in-person meetings, in restrooms, and in hallways.

408.1011(a): ACT 154, MICHIGAN OCCUPATIONAL SAFETY AND HEALTH ACT
The employer shall furnish to each employee, employment and a place of employment that is free from
recognized hazards that are causing, or are likely to cause, death or serious physical harm to the employee.
The employer did not furnish employment and a place of employment which were free from recognized hazards
that were causing or likely to cause death or serious physical harm to employees. Employees were not protected
from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the
cause of coronavirus disease 2019 (COVID-19):

a. The employer did not conduct a daily entry self-screening protocol for all employees entering the workplace,
including, at a minimum, a questionnaire covering symptoms and suspected or confirmed exposure to people
with possible COVID-19. Employees were delegated the task and left to “self-screen” on their own.

b. The employer did not maintain records of the daily entry self-screening protocols.

c. The employer had not conducted employee training on COVID-19 that covered social distancing, the use of
face coverings, appropriate hand hygiene, and workplace infection control methods.

d. The employer did not require face coverings in shared spaces, including during in-person meetings, in
restrooms, and in hallways.

Feasible abatement methods to correct this hazard are to:

a. Require face coverings to be worn when employees cannot consistently maintain six feet of separation from
other individuals in the workplace. Enforce the mandatory face mask requirement when six feet of separation
cannot be maintained or when in public and shared spaces.

b. Provide COVID-19 training to employees the covers, at a minimum: workplace infection-control practices
and the proper use of personal protective equipment.

c. Resume conducting daily entry self-screening protocols for all employees or contractors entering the
workplace, including, at a minimum, the questionnaire covering symptoms and suspected or confirmed exposure
to people with possible COVID-19.

d. Maintain a record of the daily entry self-screening protocol.
